A successful petitioner for temporary disability payments that have been willfully or negligently delayed has an absolute right to an award of attorneys’ fees from a workers’ compensation judge, a state appeals court says.

Not only are attorneys’ fees mandatory, but they are not subject to the statutory limits on fees following an award of benefits, the court held in Quereshi v. Cintas Corp., A-1848-08. Rather, they should be directly related to the costs incurred by the petitioner in obtaining the benefits.
