CIVIL PROCEDURE — DEFAULT JUDGMENT

07-2-8520 Raoof v. Chipepo, App. Div. (per curiam) (6 pp.) The trial judge abused his discretion in denying defendant’s motion for reconsideration of the denial of her motion to vacate the default judgment entered against her where defendant had advised a different judge in open court that she had discharged her attorney and would be proceeding pro se, the prior judge had not ordered her to file a substitution of attorney, the clerk did not send her a notice of the trial date, and there was no evidence to suggest that she failed to appear for trial in order to “play the system” or obstruct plaintiff’s attempt to secure relief as found by the judge. The denial of the motion for relief under Rule 4:50-1 is reversed.
