In this product-liability action, plaintiff Jamie Gannon alleged that between September 1973 and August 1976, he was administered five doses of Orimune trivalent vaccine, an oral polio vaccine, and that the vaccine, which was manufactured by American Home Products Corporation, caused his SV40 cancerous brain tumor. The complaint also named American Cyanamid Company, a subsidiary of American, and Lederle Laboratories, a wholly owned division of American and/or Cyanamid, as defendants. He contended that Orimune was improperly manufactured and contained SV40, a simian virus.
