An Atlantic County judge on Wednesday threw out a lawsuit challenging the way municipal court judges are chosen, calling the case “a meritless indictment” of every municipal judge in New Jersey.
Assignment Judge Valerie Armstrong dismissed the suit with prejudice for failure to state a claim, finding that the law governing the appointments, N.J.S.A. 2B:12-4, is constitutional under both equal protection and due process analysis.
