(20 pp.) This is a complex construction case wherein plaintiff, a condominium association, seeks damages for alleged construction and design deficiencies. Defendant K. Hovnanian is the first named defendant and is the developer/ general contractor. Plaintiff Port Imperial and K. Hovnanian claim that Gualpas Carpentry, LLC, and All-Tech Carpentry Contractors, LLC, among other defendants, are also legally responsible for certain damages. Here, the court grants Plaintiff and K. Hovnanian’s motion for reconsideration and vacates the order which had granted summary judgment to defendant Certain Underwriters at Lloyd’s of London, under which the court declared that Lloyd’s had no duty to defend or pay defenses costs on behalf of All-Tech; indemnify All-Tech for any judgment, settlement or award; and pay monies on behalf of All-Tech for injuries or losses relating to the underlying action.
