Florence v. Burlington County Board of Chosen Freeholders, Nos. 09-3603 and 09-3661; Third Circuit; opinion by Hardiman, U.S.C.J.; dissent by Pollak , U.S.D.J.; filed September 21, 2010. Before Judges Sloviter, Hardiman and Pollak, District Judge, sitting by designation. On appeal from the District of New Jersey. [Sat below: Judge Rodriguez.] DDS No. 14-8-9516 [37 pp.]

Lead plaintiff Albert Florence sued Burlington County Jail (BCJ), Essex County Correctional Facility (ECCF) and various individuals and municipal entities (collectively, the jails) under 42 U.S.C. § 1983. The District Court granted Florence’s motion for class certification. Although Florence asserted numerous constitutional claims, the only claim germane to this appeal is his Fourth Amendment challenge to the strip-search procedures at BCJ and ECCF.
