A previous Notice to the Bar requested comments on an application involving the state court litigation relating to alleged environmental contamination in Pompton Lakes, New Jersey (hereinafter referred to as “Pompton Lakes”). The application was submitted pursuant to Court Rule 4:38A and the Revised Mass Tort Guidelines as promulgated by Directive No. 10-07. The application requested centralized management without mass tort designation of the litigation and assignment to one of the designated mass tort counties. This Notice is to advise that the Supreme Court, after considering the application and the comments received, has determined to assign all pending and future litigation involving the alleged environmental contamination in Pompton Lakes to Bergen County for centralized management without mass tort designation by the Honorable Brian R. Martinotti.

Accordingly, published with this Notice are the Supreme Court’s September 13, 2010 Order and Judge Martinotti’s October 1, 2010 Case Management Order. Both orders also are posted on the Judiciary’s Internet website (www.njcourtsonline.com) in the Mass Tort Information Center (http://www.judiciary.state.nj.us/mass-tort/index.htm).
