CIVIL PROCEDURE — DISMISSAL

07-2-9891 Campbell v. Quest Diagnostics, Inc., App. Div. (per curiam) (6 pp.) Appellant filed a complaint with the Division on Civil Rights against her employer, Quest Diagnostics, Inc., alleging discrimination based upon a physical disability, and wrongful termination. Quest served on appellant’s counsel interrogatories, requests for production of documents, and requests for admissions. Appellant’s counsel failed to respond and never furnished the requested discovery. In spite of extensions of time and court orders, appellant’s counsel remained nonresponsive. Further, in violation of a directive by the ALJ, appellant’s counsel failed to enter into settlement negotiations. The Director adopted the ALJ’s initial decision dismissing the complaint with prejudice, rejecting counsel’s assertion that health issues provided good cause for the violations. The appellate panel finds the Director did not act arbitrarily or capriciously in determining that the ultimate sanction of dismissal with prejudice was warranted.
