As a Nov. 29 trial date nears for a notorious hostile-workplace case, the employer’s parent company and its board are facing vicarious liability for the alleged discrimination.
A Bergen County judge has ruled that three officers of Loving Care Agency Inc. of Fort Lee must stand trial on counts of aiding and abetting because a reasonable jury might conclude they participated in the hostile environment, promoted it or were indifferent to it.
