When a new, branded product is diverted from authorized distribution channels or imported into a country for sale without the consent or knowledge of the manufacturer, it is commonly referred to as a “gray market product.” Typically in the gray market, a consumer can find products that are normally unavailable in their home market or less expensive than when purchased through regular distribution channels.

The gray market and gray market products are certainly not new phenomena. The gray market has been in existence for well in excess of a decade. Because of the unregulated nature of the market itself, sales are extremely difficult to track and quantify. Anecdotal evidence, however, suggests that the market has continued to expand. The popularity and ease of Internet purchasing has helped fuel the growth of the gray market because of the Internet’s seemingly infinite reach.
