Although economists claim the recession is officially over, companies continue to restructure and downsize, many times eliminating jobs held by older employees or employees belonging to other protected groups.
Not surprisingly, a growing number of laid-off employees have brought wrongful termination claims, alleging that they were unfairly targeted based on age, race, disability or some other protected characteristic. Often, these former employees point to other individuals who kept their jobs within the company, or who were hired to fill job positions that had allegedly been eliminated, as proof of discriminatory treatment.
