A Monmouth County judge stretched the doctrine of probable intent beyond its limits by allowing establishment and funding of supplemental benefit trusts for an intestate decedent’s disabled children, a state appeals court held Wednesday.

In a published decision, the Appellate Division said the doctrine is a rule of will construction, which cannot be used to create a testamentary disposition when a decedent dies intestate.
