Children conceived posthumously with frozen sperm are potentially eligible for Social Security survivor benefits, the Third U.S. Circuit Court of Appeals held on Tuesday.

The court in Capato v. Commissioner of Social Security, No. 10-2027, said such offspring qualify as children for purposes of the benefits, which are meant to replace support that would have been received from the deceased parent.
