A litigant shouldn’t pay the price for his lawyer’s botched adjournment request and consequence failure to appear at trial, the Appellate Division said Thursday in reversing a default judgment in a landlord-tenant case.
The appeals court suggested that on remand, the Essex County Special Civil Part judge consider a sanction rather than a dismissal as the proper remedy.
