A New Jersey state university is not entitled to Eleventh Amendment immunity in an employment-discrimination suit, a federal judge in Newark ruled on Wednesday.
Though Montclair State University is undeniably tied to the state, it is “not under the supervision or control of the state” and its autonomy is sufficient to deny sovereign immunity, Judge Stanley Chesler held in Ventura v. Montclair State University , 08-5792.
