An Atlantic County judge has reversed a drunken-driving conviction where the Alcotest was calibrated with a thermometer other than the one specified by the state Supreme Court when it declared the breath tester scientifically reliable.
Superior Court Judge Max Baker said the justices in State v. Chun, 194 N.J. 54 (2008), had an opportunity to adopt broader language that would encompass thermometers other than the Ertco-Hart sensor, made by Fluke Corp., which it mentioned several times in its opinion.
