Plaintiff Richard H. Kress brings this declaratory judgment action seeking to enjoin enforcement of the New Jersey money-laundering statutes, N.J.S.A. 2C:21-25(a) and 2C:21-26 on the grounds that (1) the statutes are unconstitutionally vague and overbroad, (2) they impose an impermissible mandatory presumption that shifts the burden of proof, and (3) they violate the Constitution’s Commerce Clause. Opposing this action are New Jersey and Paula Dow, attorney general of New Jersey.
