A federal appeals court on Tuesday held that a Parsippany law firm can be sued for overstating amounts owed in mortgage foreclosure letters sent to debtors’ attorneys.
The Third U.S. Circuit Court of Appeals reversed a ruling by a trial judge who had found the letters, sent by Fein, Such, Kahn & Shepard, protected by New Jersey’s litigation privilege.
