For the second time in two months, a state appeals court has allowed civil rights plaintiffs to attempt to recover legal fees in a suit rendered moot by a change in the government behavior that prompted it.

On Feb. 25, the Appellate Division, in Jones v. Hayman, A-3173-09, gave four women prisoners who sued over their transfer to a men’s prison another shot at about $200,000 in legal fees.
