Few environmental issues have engendered as much controversy as the debate concerning public access rights to the state’s tidal waterways. The Department of Environmental Protection’s (DEP) proposed public access rules reflect its latest efforts to strike the right balance between the public and private interests that compete over access and use of the state’s shoreline. Proposed N.J.A.C. 7:7-7.1.3 et al.; 43 N.J.R. 772(a) (April 4, 2011).

Public hearings have been scheduled for May 12 (Jersey City) and May 17 (Pomona). The deadline for submission of written comments is June 3. Due to the requirement that the DEP respond to the comments, the full impact of the new rules will not be realized until the 2012 summer season.
