A civil rights law banning retaliation against those reporting illegal conditions at psychiatric hospitals creates no private cause of action by the whistleblower, a U.S. court ruled Wednesday in a Third Circuit case of first impression.

District Judge Joseph Irenas in Newark dismissed a nurse’s claim under the Civil Rights of Institutionalized Persons Act, finding it was intended to protect people committed to psychiatric institutions, not the employees.
