A New Jersey attorney can go forward with a suit claiming he was injured by an exploding battery pack he purchased at Pep Boys, as a federal judge ruled Wednesday that the retailer may be strictly liable for the defect.

But punitive damages are not recoverable, since neither Pep Boys nor the manufacturer, Rally Manufacturing Inc. of Miami, intentionally sold a dangerous product, District Judge Peter Sheridan in Trenton held.
