A lawyer who continued working on a personal injury case without knowing he had been replaced by substitute counsel is entitled to fees from the eventual settlement, a state appeals court ruled on Monday.

The panel found that Phillip Wiskow had a duty to proceed with the case, Rivera v. Dover VF LLC, A-3188-10, and in fact could have been liable for malpractice had he not done so.
