I read the Nov. 21 story titled “Lawyer Who Didn’t Know He Was Fired Can Collect For Work Done on the Case” with great interest. Appellate Division Judges Jose Fuentes, Ronald Graves and Ellen Koblitz reversed the trial court’s decision to award the plaintiff’s attorney, Phillip Wiskow, only $50.02 in costs in the fee dispute with attorney Raquel Romero. The panel found that Wiskow had a duty to proceed on a case where the client had fired him, but without his knowledge. Wiskow did his job in good faith even after the client had replaced him with Romero. The $55,000 settlement left approximately $17,500 in counsel fees, which should have been shared without litigation.
