Newark Nights — It may be “Newark or bust” for a gentleman’s club, now that the Appellate Division has affirmed a ruling that it can be made to leave Union Township.
The appeals court held on Friday that as applied to “Hott 22,” a law governing location of sexually oriented businesses doesn’t violate First Amendment free-expression rights, because the town and the Union County prosecutor met their standard of proof that suitable alternative locations — all in Newark — were reasonably available within the market area defined by a 14-mile radius from the original site.
