Bull v. United Parcel Service Inc., No. 10-4339; Third Circuit; opinion by Nygaard, U.S.C.J.; filed January 4, 2012. Before Judges Sloviter, Smith and Nygaard. On appeal from the District of New Jersey. [Sat below: Judge Cavanaugh.] DDS No. 07-8-xxxx [35 pp.]
Laureen Bull, a part-time employee of defendant United Parcel Service Inc., injured her neck and shoulder on the job. After two months of physical therapy she was given a temporary work assignment that did not involve lifting, after which she stopped working and began receiving workers’ compensation. Eventually, she returned to work with restrictions, but after five days her supervisor told her that her medical restrictions made it impossible for UPS to continue assigning work to her. UPS advised her to seek permanent disability.
