Qualifying as the first-filed case no longer requires getting to court first. A demand for arbitration can suffice, a state appeals court held on Friday in CTC Demolition Company, Inc. v. GMH AETC Management/Development LLC, A-3703-10.
The court, aware of only one other opinion in the country to have addressed the issue, relied on the public policy favoring arbitration and mediation to vest jurisdiction in New Jersey.
