Charitable entities do not have a nondelegable duty to protect the developmentally disabled, a divided state Supreme Court ruled Wednesday.

Expansion of the duty of due care would come “at the expense of charitable organizations and other providers of essential services” to the disabled, Justice Anne Patterson wrote for the majority in the 5-2 decision in Davis v. Devereux Foundation, A-54/55-10.
