The state Supreme Court is considering whether state university law school clinics are government entities subject to the Open Public Records Act, though they function much like law firms.

The Environmental Law Clinic at Rutgers University Law School-Newark wants the Court to overturn an appellate ruling that no blanket privilege for legal clinics is needed. James Lidon, representing the clinic, said the ruling could infringe on academic freedom and chill the clinic’s operations by potentially opening up to the public some information that, if obtained by a private law firm, would be considered protected.
