The New Jersey Supreme Court has agreed to decide whether a flat legal fee provision in a lease constitutes illegal fee splitting to the extent it exceeds the value of legal services provided.

The blanket $400 charged to tenants went to pay for the services of the landlord’s in-house lawyer in eviction actions, and was reduced to $200 if they paid their arrears before the court date.
