Lasky v. Moorestown Township, A-2742-10T3; Appellate Division; opinion by Parrillo, P.J.A.D.; decided and approved for publication May 11, 2012. Before Judges Parrillo, Skillman and Hoffman. On appeal from the Law Division, Burlington County, L-1207-09. DDS No. 46-2-6254 [20 pp.]
Plaintiff Gregory Lasky, a paraplegic, is a Florida resident who occasionally travels to New Jersey. After visiting Strawbridge Lake Park in Moorestown Township and noticing that it has unpaved parking lots, no handicap designated parking, no signage indicating access to the park or alternatives to assist the disabled, and no ramp or accessible pathways to the picnic tables, playground or lake, he filed suit alleging that the township discriminated against him by not providing him access to the park, in violation of Title II of the Americans with Disabilities Act, 42 U.S.C.A. §§ 12101-12213 (1990), and the New Jersey Law Against Discrimination, N.J.S.A. 10:5-1 to -49. A jury returned a verdict in favor of defendant.
