State v. Randolph, A-87 September Term 2010; Supreme Court; opinion by LaVecchia, J.; dissent by Patterson, J.; decided June 18, 2012. On certification to the Appellate Division. DDS No. 14-1-6668 [50 pp.]
Pursuant to a plea agreement, defendant Buddy Randolph pleaded guilty to a number of assault and weapons charges in exchange for the dismissal of the remaining charges in five indictments. The sentencing court found aggravating factors three (risk of re-offense) and nine (need to deter) and no mitigating factors and the aggravating factors supported a term greater than the presumptive term on each count to which defendant pleaded.
