A state appeals court has invalidated Department of Environmental Protection regulations that bar sales of industrial properties with trace amounts of hazardous substances.
In a July 6 ruling, Des Champs Laboratories, Inc. v. Martin, A-3235-10, the Appellate Division said the DEP had exceeded its statutory authority by eliminating an exemption for de minimis contamination.
