The state Supreme Court is considering whether a former school librarian convicted of sexual assault deserves a new trial because his lawyer failed to elicit testimony from witnesses who could have exonerated him.

The issue, in State v. Nash, A-36-11, argued Tuesday, is whether the lawyer was justified in not calling the witnesses as a matter of trial strategy, especially one who had vowed to damage the defendant’s case.
