Over the State Bar Association’s resistance, a New Jersey Supreme Court committee is proposing that lawyers no longer be allowed to coax clients to pay legal fees by holding their files or other property hostage.
The recommendation by the Advisory Committee on Professional Ethics, released on Monday for public comment, would put an end to the common-law retaining lien in New Jersey.
