Weighty Mistake — A malpractice suit against Rebenack, Aronow & Mascolo in New Brunwick was dismissed Monday — a result of the pro se plaintiff skimping on postage when mailing the affidavit of merit.

Philip Seldon of New York sued the firm and attorney Jay Mascolo in 2012 over representation in two cases, one as a defendant and one as a plaintiff. Seldon says he obtained the affidavit from New York attorney Peter Mertz and mailed it to the defendants on Oct. 22, 2012. The defendants said they never received it and moved to dismiss on Jan. 15.
