Plaintiff Geovanni Regalado appeared before Amada Curling, municipal clerk, city of Passaic, at 8:30 a.m. on the day set aside for drawing positions on the ballot for the May 14, 2013, municipal election and verbally advised her that he wished to withdraw his nominating petition for the office of mayor. She refused to accept the verbal notice.
