Francis E. Parker Memorial Home Inc. v. Georgia Pacific, L.L.C., Civ. No. 2:l2-cv-02441; U.S. District Court (DNJ); opinion by Debevoise, S.U.S.D.J.; filed May 20, 2013. DDS No. 09-7-xxxx [42 pp.]
Plaintiff Francis E. Parker Memorial Home Inc. constructed a large assisted-living facility in New Jersey using "PrimeTrim" exterior trim designed, manufactured, warranted, advertised and sold by defendants Georgia-Pacific, L.L.C., and Georgia-Pacific Woods Products, L.L.C. In this consumer class action Parker alleges that PrimeTrim prematurely deteriorates, swells and delaminates under normal conditions, causes water and structural damages, and promotes the growth of mold and mildew in the structures on which it is installed. It contends that GP misrepresented the quality of its products, thereby causing fraud and tort-based harm, and that Parker and the putative class have suffered damages as a result.
