The judge who approved a $215 million settlement of a class-action lawsuit against a health insurer is perturbed that $90 million has yet to be distributed five years later.

On May 30, U.S. District Judge Faith Hochberg ordered the parties in Wachtel v. Health Net Inc., 01-cv-4183, to show cause why she should not name a special master to investigate the delay — and to study whether class counsel should be replaced and required to return any or all of the $72 million they were paid or face sanctions or disciplinary action.
