Registrant T.H., convicted of offenses related to child endangerment, distribution of CDS in a school zone, and witness tampering arising out of his luring his daughter's young friends to his home and providing them with alcohol and marijuana, appeals from the denial of his motion to be classified as a Tier One registrant, representing a low risk to reoffend, as opposed to a Tier Two classification, reflecting a moderate risk to reoffend. The focus of his application was on criterion seven of the Registrant Risk Assessment Scale (RRAS): length of time since last offense. He was scored "one year or less" when he was initially classified. He sought to be recognized as having been out of prison more than one year but less than five years, resulting in a reduction of six points under the RRAS and, correspondingly, placing him in Tier One.
