Fees for discovery in municipal court were unpredictable until Jan. 1, 2013. Before that, there were sliding scales for the number of pages, flat fees, $5 sheets of paper and $25 data discs.

In 2009, the New Jersey Supreme Court held in Constantine v. Bass River Township that criminal discovery costs must be reasonable. On Dec. 5, 2012, the Administrative Office of the Courts notified the bar of the changes to Rule 3:13-5(a) and 7:7-7(i), effective as of Jan. 1 of this year.
