A New Jersey man serving a 16-year sentence for having a sexual relationship with his teenage daughter will get a new trial if a judge finds his confession to police was the product of coercion.

An appeals court on Monday said it was plain error for the trial judge not to conduct a hearing, under Rule of Evidence 104, on whether defendant R.P.’s confession was voluntary.
