The New Jersey Supreme Court on Tuesday affirmed a reversal of conviction for a defendant who lost his primary defense lawyer on the eve of trial and was forced to go ahead with a secondary counsel not of his choosing.
But the court, in State v. Kates, reinforced the discretion of trial judges, consistent with the Sixth Amendment, to deny requested adjournments to obtain private counsel.
