R.S. and D.S. were married in 1978. R.S. began residing in a nursing home on Nov. 1, 2010. D.S. continues to reside in the marital home. On Nov. 4, 2010, D.S. filed an uncontested complaint for separate maintenance, claiming R.S. had separated himself from her and had refused to support her. Neither the Union County Board of Social Services nor the Division of Medical Assistance and Health Services received notice of the proceedings.
