In a decision that changes the landscape of negotiations in the public sector, on Dec. 19, 2013, the New Jersey Public Employment Relations Commission (PERC) reversed course on the “dynamic status quodoctrine.” See County of Atlantic and PBA Local 243, P.E.R.C. No. 2014-40, 2013 NJ PERC LEXIS 101 (Dec. 19, 2013).??

In public sector negotiations, as with any negotiation, the biggest issue is wages. Collective negotiations agreements in the public sector often include a salary guide, which contains multiple steps enabling employees to receive higher contractual salary amounts at each step in addition to any cost-of-living adjustments. Such increases, based on movement of unit members through the salary guide, are referred to as salary increments, which are included in an employee’s base salary.
