Starwood Hotels is battling in federal court in Camden, N.J., over what it claims was an ex parte investigation into whether its hotel employees help customers procure prostitutes.
The investigation in Burgese v. Starwood Hotels & Resorts Worldwide was launched by counsel for a New Jersey woman and her husband who claim she was assaulted by a prostitute at Starwood’s W Hotel South Beach in Miami Beach, Fla. But the investigation violated ethics rules because it was launched after the suit was filed, and the plaintiffs’ representatives made no effort to tell hotel workers they were hired by an attorney engaged in active litigation against the company, Starwood claimed in court papers.
