A lawyer for plaintiffs suing Conrail over a 2012 train derailment in Paulsboro, N.J., that released toxic vinyl chloride gas will not be sanctioned for sharing an email from the government investigation with the media, a federal judge has held.
U.S Magistrate Judge Karen Williams of the District of New Jersey, sitting in Camden, N.J., held Jan. 21 that Mark Cuker, of Williams Cuker Berezofsky in Philadelphia, did not violate a July 8, 2013, protective order because the email was not marked “confidential” as required by the order.
