01-2-5964 In the Matter of A.S., Fire Fighter, App. Div. (per curiam) (6 pp.) A.S. appealed from a final decision of the Civil Service Commission upholding the decision of the City of Elizabeth that he was psychologically unfit to effectively perform the duties of a fire fighter, and, therefore, the city could remove his name from the list of eligible candidates for fire fighter. The panel affirmed, finding that after receiving conflicting psychological reports, the commission properly referred the matter to the Medical Review Panel, the panel’s report described in detail its reasoning in weighing the expert reports and was supported by the record, and the commission discussed in detail the skills and abilities required for the position as outlined in the job specification and considered A.S.’s poor decision-making and avoidance of responsibility for his choices in reaching the determination that the city met its burden of proof.
