The Trenton school board may have to pay the defense costs of a security guard who was charged in a civil lawsuit with sexually assaulting a student, the New Jersey Supreme Court ruled March 25.

In a unanimous ruling, the court said an evidentiary hearing will have to be held to determine whether the guard, identified only as L.A., was acting within the scope of his duties when the alleged assault occurred.
