01-2-6595 In the Matter of Ippolito, App. Div. (per curiam) (19 pp.) Appellant Ippolito, who achieved the highest score on a promotional examination for the position of sergeant, appealed the Civil Service Commission’s decision upholding the borough’s action in bypassing him and appointing the candidate who scored third highest to the lieutenant position. The panel affirmed, finding that: the borough’s statement of reasons for why it selected the candidate it did was not boilerplate but articulated its reasons in sufficient detail, including his holding post-secondary degrees, which Ippolito did not, his many years of community service demonstrating his extraordinary character, his military service and his performance in the interview. The panel rejected Ippolito’s argument that the interview process was unfair because his interview was bifurcated and the interview lacked a standard format or set of questions. The panel also found that the commission’s review of the borough’s decision was detailed and demonstrated that it had reviewed the certifications, briefs and other documentation provided by the parties, as well as the decision rendered by the borough.
